On May 1, 2013, 7 neighbors filed suit against the Buckhead developers of the Ashby High Rise. The case went to trial in November of 2013 with the owners of 30 homes as plaintiffs. On December 17th, the jury found that the highrise, if constructed, would constitute a private nuisance because it would unreasonably interfere with the plaintiffs’ use and enjoyment of their property. The jury also determined that the owners of 20 homes should be awarded about $1.7 million in damages if the highrise is constructed. The plaintiffs’ claims for injunctive relief remain pending with the court, and an injunction hearing is scheduled for January 27, 2014.
